Mumbai: The legal battle between the Indo-Australian couple for child custody is still on after the couple failed to reach any kind of agreement over the weekend as suggested by the Bombay High Court.

Justice Bilal Nazki and Justice A R Joshi on Friday interviewed the couple’s three-year-old child in their chamber after which the court directed the parents to pacify their dispute and settle it amicably.

The Australian mother Ruth (name changed) had filed a habeas corpus petition seeking custody of her child.

Ruth had moved court alleging that her Indian husband Javed Khan (name changed) has abducted their child on the pretext of coming to India for a few days in August last year.

However, the couple has not been able to reach an agreement as both are adamant to keep the child. Both are even ready to bear the expense of the other to visit the child few times a year depending on who gets the custody.

Speaking to media, Ruth on Monday said that she was relieved to be with her child last Saturday. “It took a little stress out of me after spending time with him,” Ruth said.

The court has now adjourned the hearing till Monday.

Khan had earlier told the judges that he will keep the child and the mother is welcome to visit the child few times a year.

Ruth and her mother had filed the petition stating that Khan has “perpetrated fraud” by forcefully keeping the child with him and not telling them about his whereabouts.

They have sought the quashing of a custody application that Khan has filed before the family court in Bandra. They have contended that the Australian court had already granted them divorce in November 2007 and handed over the child’s custody to Ruth.

Khan, however, contends that Ruth is an alcoholic who attends “wild parties” and that she has three other children with other men. He also stated that as per the Australian law, he was given protection against Ruth, an abusive spouse.
